Terms of Service for Kicker
Companion Intelligence, Inc.
These Terms govern your use of the Kicker mobile application and related services operated by Companion Intelligence, Inc. Effective Date: May 13, 2026.
1. Acceptance of Terms
By creating a Kicker account, downloading the Kicker mobile application, or otherwise accessing or using the Services, you agree to be bound by these Terms of Service (the "Terms"). The Services include the Kicker mobile application, the website at www.usekicker.com, and any related software and content provided by Companion Intelligence, Inc. ("Companion Intelligence", "we", "us", or "our"). If you do not agree to these Terms, do not use the Services.
2. Use License and User Conduct
Subject to your compliance with these Terms, Companion Intelligence, Inc. grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Kicker on devices you own or control, solely for your personal, non-commercial use of the Services. You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the App; (b) use the Services to infringe any third party's rights or to engage in illegal activity; (c) interfere with or disrupt the Services or any servers or networks connected to the Services; or (d) use any automated system to access the Services in a manner that sends more requests to our servers than a human can reasonably produce.
3. AI Output Disclaimer
Kicker uses third-party large language models to generate task suggestions, summaries, and conversational responses. AI output may be inaccurate, incomplete, or out of date. The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose of any AI-generated content, and we disclaim all warranties to the maximum extent permitted by applicable law. You are responsible for reviewing AI output before acting on it, especially for decisions that have legal, financial, medical, or safety consequences.
4. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Companion Intelligence, Inc. or its suppliers, officers, or employees be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of data, loss of profits, business interruption, or personal injury) arising out of or in connection with your use of, or inability to use, the Services - even if Companion Intelligence has been advised of the possibility of such damages. Our aggregate liability to you for any claim arising from these Terms or the Services will not exceed the amount you have paid to Companion Intelligence for the Services in the 12 months preceding the event giving rise to the claim.
5. Subscriptions and Auto-Renewal
Kicker offers auto-renewable subscriptions sold through the Apple App Store on iOS and Google Play on Android. By starting a subscription, you agree to the following terms in addition to the billing rules of the applicable app store.
A. Subscription Plans and Pricing
We offer monthly and yearly subscription plans for Kicker Pro. The current title, length, and price of each plan are displayed in the app prior to purchase and shown again by the App Store or Google Play at the point of confirmation. Prices may vary by country and may be adjusted from time to time; any price change will be disclosed before it takes effect and, where required by the platform or applicable law, will only apply to your subscription after you affirmatively consent.
B. 14-Day Free Trial
Eligible new users may be offered a 14-day free trial. To start the trial, you must provide a valid payment method to the Apple App Store or Google Play. Unless you cancel at least 24 hours before the end of the 14-day trial period, your subscription will automatically convert to a paid subscription and your payment method will be charged at the price shown for the selected plan. Trial eligibility is determined solely by Apple or Google based on your store account; if you are not eligible (for example, because you have already used a free trial for this subscription group), the subscription will begin as paid immediately upon purchase.
C. Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or yearly, as selected) at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your payment method will be charged within 24 hours prior to the end of the current period. Each renewal will be of the same duration as the previous period.
D. Managing and Cancelling Your Subscription
You can view, manage, or cancel your subscription at any time through your store account. On iOS: Settings → [your name] → Subscriptions. On Android: open Google Play → Profile → Payments & subscriptions → Subscriptions. Cancellation takes effect at the end of the current billing period; you will continue to have access to paid features until that time. Uninstalling the app or deleting your in-app account does not cancel your subscription with the app store.
E. Refunds
All purchases made through the Apple App Store or Google Play are subject to the refund policies of those stores. We do not directly process refunds for in-app subscriptions. To request a refund, please contact Apple at https://reportaproblem.apple.com or Google Play at https://play.google.com/store/account. Where applicable consumer protection laws grant you a non-waivable right of withdrawal, those rights are preserved.
5A. Apple App Store EULA Provisions
If you obtained the Kicker application from the Apple App Store, the following additional terms apply. These terms are required by Apple Inc. ("Apple") and are intended to supplement, not replace, the rest of these Terms.
- Acknowledgement. You acknowledge that these Terms are concluded between you and Companion Intelligence, Inc. only, and not with Apple, and that Companion Intelligence, not Apple, is solely responsible for the Kicker application and its content.
- Scope of License. The license granted to you for the Kicker application is limited to a non-transferable license to use Kicker on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and Support. Companion Intelligence is solely responsible for providing any maintenance and support services with respect to Kicker as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Kicker application.
- Warranty. Companion Intelligence is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Kicker to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Kicker application to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Kicker.
- Product Claims. You and Companion Intelligence acknowledge that Companion Intelligence, not Apple, is responsible for addressing any claims by you or any third party relating to Kicker or your possession and/or use of Kicker, including, but not limited to: (i) product liability claims; (ii) any claim that Kicker fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights. You and Companion Intelligence acknowledge that, in the event of any third-party claim that Kicker or your possession and use of Kicker infringes that third party's intellectual property rights, Companion Intelligence, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary. You and Companion Intelligence acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
